{"id":563,"date":"2023-03-30T09:14:51","date_gmt":"2023-03-30T09:14:51","guid":{"rendered":"https:\/\/avocat-grezillier.fr\/?p=563"},"modified":"2023-03-30T09:14:51","modified_gmt":"2023-03-30T09:14:51","slug":"louer-des-terres-en-zone-agricole-necessite-t-il-de-conclure-un-bail-rural","status":"publish","type":"post","link":"https:\/\/avocat-grezillier.fr\/index.php\/2023\/03\/30\/louer-des-terres-en-zone-agricole-necessite-t-il-de-conclure-un-bail-rural\/","title":{"rendered":"Louer des terres en zone agricole n\u00e9cessite-t-il de conclure un bail rural?"},"content":{"rendered":"\n<p id=\"viewer-foo\">Louer des terres agricoles, au sens du droit de l&rsquo;urbanisme, permet-il syst\u00e9matiquement au preneur de conclure un bail rural et de b\u00e9n\u00e9ficier du statut tr\u00e8s protecteur du fermage ?<\/p>\n\n\n\n<p id=\"viewer-62hgu\">En r\u00e9alit\u00e9, le fait qu&rsquo;une parcelle soit class\u00e9e en zone \u00ab\u00a0A\u00a0\u00bb dans le plan local d&rsquo;urbanisme d&rsquo;une commune n&rsquo;a absolument aucune cons\u00e9quence sur la nature du bail qu&rsquo;il conviendra de conclure.<\/p>\n\n\n\n<p id=\"viewer-6gvhm\">Ind\u00e9pendance des l\u00e9gislations oblige : le droit rural ne d\u00e9pend pas du droit de l&rsquo;urbanisme !<\/p>\n\n\n\n<p id=\"viewer-e5vsm\">Les crit\u00e8res du bail rural sont en revanche clairement d\u00e9finis aux articles L. 411-1 et suivants du code rural et de la p\u00eache maritime.<\/p>\n\n\n\n<p id=\"viewer-f2hq3\">Pour m\u00e9moire, l&rsquo;article L. 411-1 du code rural et de la p\u00eache maritime dispose que : \u00ab\u00a0<em>Toute mise \u00e0 disposition \u00e0 titre on\u00e9reux d&rsquo;un immeuble \u00e0 usage agricole en vue de l&rsquo;exploiter pour y exercer une activit\u00e9 agricole d\u00e9finie \u00e0 l&rsquo;article L. 311-1 est r\u00e9gie par les dispositions du pr\u00e9sent titre, sous les r\u00e9serves \u00e9num\u00e9r\u00e9es \u00e0 l&rsquo;article L. 411-2. Cette disposition est d&rsquo;ordre public.<\/em>\u00ab\u00a0<\/p>\n\n\n\n<p id=\"viewer-6ee4a\">Trois conditions doivent \u00eatre r\u00e9unies pour que le bail soit, de plein droit, soumis au statut du fermage :<\/p>\n\n\n\n<p id=\"viewer-as1vo\">&#8211; premi\u00e8re condition: une mise \u00e0 disposition \u00e0 titre on\u00e9reux (cette premi\u00e8re condition est en r\u00e9alit\u00e9 double et pose un certain nombre de difficult\u00e9s),<\/p>\n\n\n\n<p id=\"viewer-diqh6\">&#8211; deuxi\u00e8me condition : une mise \u00e0 disposition d&rsquo;un immeuble \u00e0 usage agricole, ce qui inclut les terres destin\u00e9es \u00e0 la culture et les b\u00e2timents n\u00e9cessaires \u00e0 l&rsquo;exploitation agricole,<\/p>\n\n\n\n<p id=\"viewer-4ocve\">&#8211; troisi\u00e8me condition : une mise \u00e0 disposition en vue d&rsquo;exercer une activit\u00e9 agricole au sens de l&rsquo;article L. 311-1 du code rural et de la p\u00eache maritime. Cette derni\u00e8re condition est \u00e9galement source de difficult\u00e9s.<\/p>\n\n\n\n<p id=\"viewer-a6ran\">Il en r\u00e9sulte que la zone &#8211; au sens du droit de l&rsquo;urbanisme &#8211; o\u00f9 se situent les terres lou\u00e9es est indiff\u00e9rente pour l&rsquo;application &#8211; ou non &#8211; du statut du fermage.<\/p>\n\n\n\n<p id=\"viewer-f7962\"><em>Petits cas pratiques<\/em><\/p>\n\n\n\n<p id=\"viewer-bog0n\"><em>Question 1<\/em> : si je loue des terres situ\u00e9es en zone \u00ab\u00a0A\u00a0\u00bb pour y exploiter une ICPE (telle qu&rsquo;une installation de stockage de d\u00e9chets inertes ou une carri\u00e8re), le statut du fermage est-il applicable de plein droit?<\/p>\n\n\n\n<p id=\"viewer-cspvj\"><em>R\u00e9ponse<\/em> : <em>a priori<\/em>, non.
